Rule 13 is the nuclear option. If you want to come here and demand all zero pieces of your art that have been uploaded be removed, that is your route to do so. Ya know, the one I had to stop my own things going on to provision infrastructure for. Because every website needs to have its professionalism judged by the robust nature of its legal machinery to deal with bad faith claimants insisting on imperative urgency for resolution of concerns regarding hypothetical instances of infringing posts, before it’s even 3 days old. Lest all the forces of Hell be raised.

If it seems unusual to you, it just means you’ve never ventured through the legalese of every single social media and user generated content host on the internet. All of them have this exact same red tape for a point of contact, and contact through that avenue requires the delivery of a written statement meeting those criteria, all aforementioned defined by USC Title 17 and CFR Title 37.
 
Basically, I’m an old man an I don’t have time or patience for teenager social media clout pranks. Anyone not coming at me for disingenuous reasons will likely have a much easier time getting whatever cooperation they are seeking. Sometime after I wipe out a good chunk of my sleep deficit.

Instead of the regular shitposting, an actual suggestion.  
As it is currently, an artist can request artist upload only with no edits. If this artist were to just simply never upload, anything over 3 months would be free for regular users to upload.  
This is not the same with edits.  
If an artist were under artist only + no edits, edits of a piece over 3 months would not be allowed since “no edits” is simply no edits ever, period.
 
I would suggest that edits on art older than 3 months be free game for anyone under artist only + no/limited edits as long as they are published under the “artist edits” tag.  
This would please the crowd of memelords who want to make edits but also make sure the DNP request of the artist is mostly kept as their artist tag wouldn’t be flooded by low quality and shit edits.  
The edit tag could also be put on the default filter to keep any might-be offensive edits out of public eye.
 
Going further, if this is really an archival focused site,
Do not upload edits without either permission (ideal) or a reasonable expectation the artist is okay with them; by default, before considering their past art/behavior/statements/etc., it’s expected artists aren’t okay with changes to their signature/watermark or huge thematic changes like majorly changing which fetishes, characters, races, or political stances are in an image.
Always tag “edit” to distinguish from the original.
 
Is simply too restrictive. Almost any edit could be removed for rule 2 (and 0 or 11 due to the nature of many edits) on a whim, which would just push this site into the same shitty state derpi is at with horrible censorship problems.

All I needed was sufficient proof that the art was in fact mine. I don’t care how much you want to roleplay as a lawyer, This rule is absolutely draconian and unnecessary, as is the rule I made this thread for. “bUt dUdE yOu HaVe zErO pIeCeS oF aRt oN hErE”. Yea, and I want to fucking keep it that way, but I see now that my wish will more than likely not be honored here.
 
You guys aren’t preserving precious history here. You’re preserving fan art and porn of a cartoon for little girls. Either stop larping, or stop pretending you respect the artists you feel so entitled to the art of.

Just because one site removes art because someone ask nicely doesn’t mean they all will.  
As an archival site there’s no reason to remove anything unless pressured by legal action.  
Don’t like it? Prove you truly own your art. You’ll likely fail because you drew cartoon horses owned by Hasbro.

I’m pretty sure you can keep the rules as they are now for cannon Characters since the Artists don’t really have rights to those pictures. Hasbro has.  
However, you should reconsider those rules for OC’s. That stuff could get you sued.

There is no “punishing greedy artists” here, nor do I want that sentiment about the DNP. They’re designed to promote the archival of works that may be lost, additionally there’s a clause there designed to prod those who enjoy the artwork to toss them money or views depending on platform. The purpose of the site is to be a running archive, not a piracy platform. There’s enough boorus that fill the role already. I set the DNP with the help of a few dozen artists who looked it over and settled on / suggested the timeframes with optional extensions.

Could you elaborate a bit more on the 6 month restriction for paid video content, but 1 year for paid artwork? What’s the reasoning behind the difference, and behind making static art more restricted than animations (while the latter usually require significantly more effort)? Is this something you threw together as some initial numbers and will be looking at, or are these explicitly picked out values with solid reasoning behind them?

The thought process around this is based on YouTube monetization data, where much of the revenue stream is generated within the first month of release, whereas art tends to be a slower medium to gain followers, and thus a revenue stream.  
The numbers were pretty arbitrarily set, but has a decent backing among all of the artists I asked who sell the art they make that are not commissions. It was indicated that art style generally improves by the time a year rolls around, and that having extra boost to their viewing would be preferred over a permanent lockup of their art.

for the sake of transparency why not disclose who are these artists that are supporting and helping making the site? they don’t speak for every artist so at least knowing who’s behind the thinking process to these decisions around DNP would be a step in the right direction IMO

Artist Upload Only & Permission Upload Only: If you have this type of DNP assigned , you or the permissioned uploaders have 3 months to upload before users can upload your art.
 
So artist-upload-only DNPs are basically useless? Or do you have to refresh your DNP every 3 months? This seems like a really weird rule that completely defeats the purpose of a DNP.

It seems like all that rule does is if you’ve made a piece of art and haven’t gotten around to uploading it here, after 90 days someone can do it for you instead. Seems reasonable to me.

I think what they’re shooting for is allowing artists to make money off their art. I don’t know if Zizzy wrote it here or on /mlp/ but he consulted with many artists and they said the most money is made when the art is new and it drops off rapidly.

Jesus christ, absolutely do not under any circumstance take control away from artists over their own content, and for the love of god extend the minimum time of non-public paywalled content to 1 year minimum, with the ability for the artist to say no and request takedown.
 
There was absolutely nothing wrong with Derpibooru’s DNP system and the control it offered to artists over their own art if they cared or had a problem with something, and there is zero reason whatsoever to change any of this, what are you even doing.

I guess I didn’t quite explain this properly in the rules. It’s more of a “you have complete control over works newer than 90 days, from being uploaded to the site as an archive.” Though I might adjust this to 120 days (4 months)

Derpi has proven to not be an archive, giving complete control over what gets uploaded.  
The other two boorus have proven to be very artist hostile, no dnp types, no takedowns.
 
I’m right in the middle here, trying to work out a balance that’ll allow this place to be an archive, where if something is indeed a problem an artist can follow the same DMCA process they’d follow for other sites. I’m still adjusting things, but this is intended to be a searchable archive of fan works.
 
I’ve created multiple more restrictive DNP types for artists on how their art is handled when uploaded.
