Regarding DNP rules

Demb

“If an artist removes all legitimate ways to acquire their art, via paid or unpaid means (Patreon, DeviantArt, Twitter, etc) an exception will be made to allow users to upload their art.”

Why?

If an artist removes all legitimate ways to acquire their art, it’s probably because they don’t want their art to be public anymore. Making an exemption to allow people to post art the artist had decided to remove everywhere else doesn’t exactly sound like “respecting artists and their artwork” to me. I made an account here specifically to be put on the DNP, but with this rule in place doing so would be completely pointless.

To be fair, while the intent is obviously archiving, I would be inclined to agree and I don’t think this is really a useful rule. The Pony Archive would almost certainly contain all images that were posted to any of the booru at any point, and a searchable interface to it that could be used to locate art is apparently planned. And if the art is at all notable or has at least a few people caring about it, chances are it’s probably getting backed up on Rainbooru as well. So in that sense, there’s not that much benefit from having Ponybooru specifically making it available, and I’d argue in favour of artist rights in this case.

Seems like a pretty weird line to me, as well. DNPs are already being honoured, which means that edits can often have “no other legitimate place” to be uploaded (again, except Rainbooru or archives), yet Ponybooru is fine with no-edits DNPs, taking the stance of the artists and delegating the task of archiving to other sites. Yes no-nothing DNPs have an exception, which expectedly will annoy artists.

I do know that rules are supposedly going to be updated soon (and are expected to generally not be set in stone during this early period anyway), so maybe this can be reconsidered.

I don’t see DNP being honored at all when you’re obligated to actively support the site and be active to get an artist upload only rule.

Besides a lot of people have been showing on twitter already they don’t want their art here but are being ignored, to add injury to the cause, exclusive paywall content is being uploaded in here… on derpibooru this would be deleted under their rule #1 while here it’s pretty much a shrug

While I have zero affiliation with staff, I’ve been following the development of all these alternative boorurather closely, and my understanding is that Ponybooru very much intends to respect DNPs. However, it is an extremely young website, it’s still getting set up, and the staff are all very busy getting things working. Again, while I can’t speak for staff, personally I do very much expect for the backlog of requests to get worked through, with offending images deleted. So unless I’m wrong, artists would then basically just need to “suffer” unauthorized uploads being up for a couple of weeks until this gets sorted.

In contrast, Derpibooru has like two dozen staff members who are all experienced with the codebase and tools, well established workflows, and a stable, long-standing website. Their entire workload consists primarily of moderation, rather than “getting things set up”, and they have a larger team. So of course things are processed much faster on Derpi than on here. (Even so, Derpi apparently still has a lengthy backlog of DNP requests that are waiting to be processed, based on what I heard.)

A lot of artist are looking to leave Derpi and wanted an alternative to post their art to. Nobody expected such a shitstorm and such incompetence from the Derpi admins.
Genuine question, how terrible is it if a fledging site with a tiny userbase hosts your art without permission for a couple of weeks, without malicious intent?

If an artist wants their art to not be posted, they have that right.

You can hardly claim to support artists’ freedom of expression if you won’t respect artists’ wishes to have their artwork not hosted here.

this is an archive site, not a booru proper.
the artist have the right to shove a broomstick up their rear end if they don’t want their drawings of copyrighted characters shown to people because for some reason they think they own the rights to it.

@The_Man
you said it mate, rainbooru doesn’t give a shit about dnp and what not and it’s still going strong.

this place ain’t for the politically correctness, there are other places they can go

I thought this was a booru proper, meant to attract artists directly. While Rainbooru is the archive site, the one that actually flies the skull and crossbones and welcomes all artwork, paywalled, DNPed, anything.

If this is gonna be an archive strictly, then things like forbidding paywalled artwork is counterproductive.

The DNP policy has been updated per the site rules. Please check them.

“If an artist removes all legitimate ways to acquire their art, via paid or unpaid means (Patreon, DeviantArt, Twitter, etc) an exception will be made to allow users to upload their art” is still there.

If an artist really wants their art down everywhere, and specifically reaches out to you to remove it, will you honor their request or not?
Anonymous #795E
Hm, I disagree with this exception. I feel like if an artist wants to take down their work that should be honored.

this is not a booru proper that will take down art on a whim. this is an archive site that will prioritize keeping art. if you would, a booru-style archive site is the best description.
art behind a paywall and edge cases like leaked art from a hacked dropbox are the few legitimate things that could land the site in real legal trouble.

agree to disagree. art will be preserved regardless you like it or not.

@The_Man

I’m not sure if you have a legal case or not honestly. Fan art’s a grey area as it is.

Hm.

Oh well, it’s something to think about.

@Crazieman

So we have to give this site our real-life address and phone number to get our art removed.

That’s pretty unreasonable.

DNP policies and options have had a major overhaul, it takes work to get things right. I recommend reading the rules again. Still not 100% as we’re still in beta, but there’s a lot more options centered around maintaining an archival booru.
